NEW YORK (AP) — In a high-profile case resonating within the #MeToo movement, jurors could not reach a unanimous decision in Harvey Weinstein's rape retrial, necessitating a mistrial on Friday. This case marks the third time Weinstein has faced trial regarding these accusations.

Weinstein, the former Hollywood mogul, who is already serving time for other sex crimes, received a mix of reactions as news of the deadlock emerged. The prosecution faces a difficult decision as they contemplate whether to attempt a fourth trial, especially after reports that nine out of twelve jurors seemed inclined towards acquitting him.

Attorney Marc Agnifilo reflected on the partial victory, stating, Maybe it’s not the win that he wanted, but it’s a win, and we’re going to keep fighting. Meanwhile, Weinstein exhibited little emotion as he was escorted from the courtroom.

The deliberations began on Wednesday and within 90 minutes on Friday, both the defense and prosecution reported that jurors were unable to agree. Judge Curtis Farber then announced a mistrial.

Jurors' Opinions

Post-deliberation, some jurors expressed doubt regarding the accuser, Jessica Mann's reliability. Juror Josh Hadar noted, The prevailing thought was that the witness had a lot of inconsistencies in her story and leaned towards acquittal due to reasonable doubt.

Another juror, Sarae Perez, a student of feminism and familiar with the #MeToo context, admitted to similar uncertainties about Mann's testimony, stating, There were places where we couldn’t trust her word for it.

Accuser’s Response

Mann, now 40, stressed that the mistrial would not diminish her truth, stating, I deserve justice, which is why I stand up and face unbearable public scrutiny in the name of a greater good.

After the verdict was announced, Manhattan District Attorney Alvin Bragg commended Mann for her bravery, affirming that the office would consult her before deciding on next steps.

Background on the Case

Weinstein's past includes accolades as a powerful figure in Hollywood, matched with a litany of allegations leading to his downfall. His conviction in 2020 was overturned in appeal, culminating in this retrial over Mann’s claims of rape that occurred in 2013 under coercive circumstances.

The retelling of Mann's accounts described her saying no repeatedly during the incident in question as Weinstein allegedly overpowered her. Hers and Weinstein’s attorneys are poised for their next moves in this ongoing saga centered on accountability and the complexities of sexual violence allegations.
